Scotland has enacted a new hate crime law on Monday with criticism of posing a threat to free speech. Author JK Rowling and Elon Musk are among the critics of the Hate Crime and Public Order (Scotland) Act.

Rowling, who is known for her criticism of certain transgender activism, labeled the law as “ludicrous” in a statement on X last month. Similarly, Musk highlighted discussions surrounding the legislation as an “illustration of why preserving freedom of speech is paramount.”

According to the Independent report, not all officers have completed the online training course on Scotland’s new hate crime law, said one of the deputy chief constables of the police force.

“As of Thursday, only 10,000 officers had completed an online training module of the more than 16,000 on the books,” as per a report on The Independent.

Senior police officials have also anticipated a surge in complaints regarding online content, while the Scottish government maintains that the law offers essential protection against hate and prejudice while safeguarding individual expression.

Speaking to BBC radio 4, the SPF general secretary David Kennedy said, “Our biggest complaint right from the beginning of this is there’s been no extra money given to the police service to provide the extra training.”

Kennedy, who hasn’t done the training yet expressed concerns that “it’s more work on police officers and less training” and it may reduce public trust in the police.

The Hate Crime and Public Order (Scotland) Act 2021 introduces a new offense of “stirring up hatred” based on age, disability, religion, sexual orientation, transgender identity, or being intersex. Perpetrators could face a maximum prison sentence of seven years.

Under the new law, individuals can be prosecuted for communicating material or behaving in a manner that a reasonable person would deem threatening or abusive, with the intent to incite hatred based on protected characteristics. This legislation amalgamates previous laws, extending protections to include characteristics like race, color, nationality, and ethnicity.
