Trump would have faced conviction for 2020 election interference, says counsel report

President-elect Donald Trump would have faced conviction for attempting to overturn the 2020 U.S. election results had he not secured a second term as President, according to a partially released report from Special Counsel Jack Smith. The report, disclosed early Tuesday, states that the evidence against Trump was “sufficient to obtain and sustain a conviction at trial.”

Reacting on his Truth Social platform, Trump dismissed the findings as “fake” and criticized the investigative process. The Department of Justice report detailed the case further, emphasizing that the U.S. Constitution prohibits prosecuting a sitting president. “But for Mr Trump’s election [in 2024] and imminent return to the presidency, the office assessed that the admissible evidence was sufficient to obtain and sustain a conviction at trial,” the report stated.

In a letter accompanying the report, Smith rejected allegations of political bias. The BBC reported Smith’s assertion: “The claim from Mr Trump that my decisions as a prosecutor were influenced or directed by the [President Joe] Biden administration or other political actors is, in a word, laughable.”

The report also revisited the January 6, 2021, insurrection, accusing Trump of employing “unprecedented efforts to unlawfully retain power.” It outlined the challenges investigators encountered during the case, which has now been submitted to Congress following extensive legal debates.

Trump faced accusations of pressuring officials to overturn the 2020 election outcome, propagating false claims of election fraud, and inciting the insurrection at the U.S. Capitol. The insurrection, occurring two months after Trump’s defeat to Joe Biden, saw a mob of his supporters storm the Capitol building in a violent attempt to disrupt the certification of the election results.
